If you do not agree, please do not use this website. These terms apply to website use; construction work itself is governed by your signed project contract, which prevails in any conflict.
Home New Upgrade provides home renovation and remodeling services including interior and exterior renovation, roofing, solar, windows, flooring, security and fire-safety installation, and related design and project management across the United States, subject to state licensing availability.
All content on this website — including package pricing ("from" figures), imagery, timelines, and examples — is provided for general information only and does not constitute a binding offer. Written estimates are valid for 30 days from issue. Only a signed, itemized fixed-price contract constitutes a binding agreement on scope, price, and schedule.
Any change to scope, materials, or finishes after signing requires a written change order stating the cost and schedule impact, signed by both parties before the changed work proceeds. No verbal changes will be honored or billed.
You agree to: provide accurate property information and safe, reasonable access to the work area; secure pets and valuables; make selections within the timelines stated in your contract; and promptly report concerns to your project manager. Delays caused by unavailable access or late selections may adjust the schedule.
Unless your contract states otherwise, the Company obtains all required permits, schedules municipal inspections, and ensures work complies with applicable building codes in your jurisdiction.
Completed work carries a 5-year transferable workmanship warranty (10 years for Heirloom-tier contracts) from substantial completion, excluding normal wear, homeowner or third-party modifications, and manufacturer defects (which are covered by the manufacturer's warranty). The warranty is detailed in your project contract and is the exclusive remedy for workmanship claims.
To the maximum extent permitted by law, the Company's total liability arising from any project or website use is limited to the amounts actually paid by you for the affected work. We are not liable for indirect, incidental, or consequential damages (including loss of use or enjoyment of the property) except where such limitation is prohibited by law. Nothing here limits liability for negligence causing personal injury or breach of statutory warranty rights.
Financing is provided by independent third-party lenders. The Company is not a lender, makes no credit decisions, and does not guarantee approval, rates, or terms. *Promotional APR offers are set by the lender and subject to credit approval.
Either party may terminate a project contract for material breach with 10 days' written notice to cure. Upon termination you pay for work performed, materials ordered, and reasonable demobilization costs, as itemized in your contract.
All website content, designs, renders, and marketing materials are the property of Home New Upgrade or its licensors and may not be reproduced without written permission. Design documents created for your project are licensed to you for use at the project property only.
These terms are governed by the laws of the State of Nebraska, USA. The parties agree to attempt good-faith resolution and, if needed, mediation before litigation in the state or federal courts located in Lincoln County, Nebraska, except where consumer-protection law grants you a different forum.
The website is provided "as is" without warranties of any kind. We do not warrant uninterrupted access or freedom from errors, and we may modify or discontinue any part of the site at any time.
